These Terms of Sale governs the sales of products on Medcart website and mobile application (together defined as “Site”). Medcart is Owned Medica Future Portal LLC, a limited liability company registered in the United Arab Emirates (“UAE”), Department of Economic Development Dubai under license number 898609, with its office located at Hamdan Innovation Incubator, Business village B, Port saeed, Dubai in the UAE.

Please read these terms carefully before placing an order with Medcart. By placing an order with Medcart, you are agreeing to be bound by these terms with immediate effect.

1. Registration

You are the only authorized User of the Account you create using Medcart services. The registration action constitutes your acceptance of the Terms and policies of services listed on the Medcart platform. The user is responsible for the completeness and accuracy of the data entered. The data needs to be updated by the user that can be amended at any time from the respective interface of the Service. Medcart has no responsibility over the use of the User account and expressly disclaims any liability. Should you suspect that any unauthorized party might be using your Account, you are obligated for your own security to notify Medcart immediately by email at info@medcart.ae. You are authorizing Medcart to use the mobile phone number registered in your account for contacting you to complete the services including sending notifications, text messages for promotions and offers and shipping services.

2. Order process

Orders are placed by the user and Medcart shall confirm to the User the order within Service interface either by email, text messages or platform notification. If we are unable to accept your order, we will inform you in writing or through a phone call with no charges

3. Payment

You can choose one of the payment methods available with Medcart:

Cash on Delivery

Online payment

By placing your order, you are authorizing Medcart to process the payment through our third-party payment provider to process your credit/debit card details for the amount of your order. You may be required to create an account for you with our third-party payment provider. This means you accepting their standard terms and conditions and authorize us to submit your details to them on your behalf.

We accept payments online using Visa, MasterCard and AMEX (valid for UAE only) credit or debit card in the currency of the country where the User is located at the time of ordering.

The User can select which payment method as displayed during the order process as displayed for selection. If for any reason the online payment transaction is declined, Medcart is entitled, at its soles discretion, to cancel the order.

4. Prices

All prices are quoted in UAE local currency (Dirhams). Where VAT is applicable the prices displayed on the platform will be VAT inclusive. Medcart reserves the right to change prices as to update them at any moment.

5. Amending and cancelling order

The User may not be able to amend the order once it has been confirmed. The user can cancel the confirmed order prior to shipping. Medcart may cancel the order if the payment is not processed or you do not allow us, within a reasonable time, to deliver the products to you or collect them from us.

6. Delivery of the item

Delivery cost and estimated delivery date will be displayed during the process of completing the order. In case of delivery delay that is outside of our control, Medcart will contact you to let you know and take the necessary action to minimize the delay effect. The user is responsible to provide accurate address details and respond to communication that shall take place to arrange the delivery by our third party shipping provider. In the event of inavailability to receive the item after confirmation of delivery date & time, re-arranging the delivery will be charged for its cost. Medcart is responsible to provide the user with the receipt upon delivery.

Medcart may deem necessary at certain situations to verify your identity and/or ownership of the credit card by requesting that you provide us with further information such as identification and/or credit card. If we are unable to verify or authenticate any information you provide, we have the right to refuse delivery and cancel the order.

In the instance of Delivery Overseas is required, you are required to ensure that your ordered products can be lawfully imported, comply with all laws and regulations and to pay all fees and customs duties relevant to your purchase.

An electronic invoice will be issued for your purchase and send to you to the email addressed that is registered in your account

7. Returns

Return of item is acceptable in the following cases:

• You have received a wrong item
• You have received an item that is not as described on Medcart site
• You have received a damaged item
• The item is not suitable to you ;“ in certain conditions” an based on Medcart approval

The item must be returned within 7 days of receipt of the shipment. The item must be unused, in original unbroken packaging and includes all tags.

You do not have a right to return, replace or exchange items in the following cases

• any consumable item which has been used or installed
• Items that are classified as hazardous materials or use flammable liquids or gases
• items that have been used or damaged by you or are not in the same condition as you received them
• items with tampered or missing serial numbers

to rearrange a return: contact us using our email, live chat on the platform or call us on the mentioned phone number on our website

8. Refund

For items that are not delivered, you will receive a full refund if you cancel the order under clause 5

For items that are delivered, and are applicable for return as per clause 7, Medcart will refund you the item amount in full plus the return shipping cost

The refund will be issued to you as per your payment method i.e to your credit card or to your wallet

Your refund will be initiated once the item is received back with our supplier and inspected by their team. The final refund will be received by you as follows:

• if the refund is to your credit/debit card, within thirty (30) days from the day on which we receive the item back
• if the refund is to your wallet, you will receive the refund immediately after the item is received back
• if the order is cancelled before shipping, an automated refund will be initiated.

9. User Legal obligations

As a party of this agreement, you acknowledge and bound with the following:

• Adherence to the laws in force at all times and to legislation and regulations, including - without exception - all legislation, laws and regulations that protect privacy
• You have all the powers and eligibility to enter into this agreement and pay the dues according to the terms and conditions contained therein
• If you purchased items on behalf of a company, you confirm that you represent it and act on its behalf and that it will adhere to these terms of sale
• According to clause 9 , our services are provided to you based on the "as it is" basis without any guarantee or conditions from us of any kind. We disclaim our responsibility for any guarantee, approval or conditions of any kind, expressed, implied or direct; Including, but not limited to, all conditions, representations, and guarantees related to marketability or fitness for a specific purpose or public purpose, non-infringement, compatibility, or that the services are safe, or error-free, or that would operate without interruption or be provided in a correct, appropriate and timely manner, or in general.
• The sole warranty provided to you is the warranty expressed in the warranty policy

10. legal liability

These terms of sales do not have any term that exempt, limit or exclude any party from the following

• Fraud, including false misrepresentation, committed by that party
• Death or personal injury caused by the negligence of that party
• Any other liability that may not be limited or excused under applicable law

Medcart will not be responsible for:

• losses that were not caused by any breach on our part
• any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure)
• any indirect or consequential losses that were not foreseeable to both you and us when you commenced using the Medcart Services

As permitted by applicable law, we will not be legally responsible, and you confirm your agreement that you will not hold us responsible for any damages or losses that may arise from the following situations, either directly or indirectly:

• delayed delivery of the purchased items or failure to deliver part of them if you yourself have failed to provide us with the necessary information for delivery within a reasonable time or if you have failed to pay the value
• Damages that may result from unauthorized repairs to items
• Loss of any data stored or saved in items that were repaired or replaced.
• Your use or inability to use the item you have ordered
• Delay or disruption of the site or delay or interruption of our services
• Your loss of a job opportunity, your inability to conduct your business, or the like due to our inability to deliver the item you ordered on time

11. General

• These conditions are governed by and construed in accordance with the laws of the Dubai
• We reserve the right to make changes to any Medcart Services, policies, terms and conditions including these Conditions of Use, and Service Terms at any time. You will be subject to the terms and conditions, policies and Conditions of Use in force at the time that you use the Medcart Services. If any of these Conditions of Use is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition
• A person who is not a party to these Terms of Sale has no right to enforce any of its term
• You can contact us on e-mail : info@medcart.ae, social media channels, or online chat in case you are not satisfied with any product that is purchased through Medcart
• None of the parties shall be held responsible for any delay, damage, failure or losses resulting from causes outside of their control, whether it is possible to predict or unpredictable.
